These Terms and Conditions (“Terms”) govern your access to and use of the DesiPlat website, assessments, reports, document templates, and related digital services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Services.


1. About DesiPlat

DesiPlat is a digital platform providing automated compliance readiness assessments, informational reports, and documentation templates related to the Digital Personal Data Protection Act, 2023 (DPDP Act) and other regulatory frameworks.

DesiPlat is operated in India as a sole proprietorship under the trade name DesiPlat.


2. Nature of Services (No Legal Advice)

The Services provided by DesiPlat are informational and educational only.

  • DesiPlat does not provide legal advice, legal opinions, regulatory certifications, or guarantees of compliance.

  • All outputs generated through assessments, reports, or document templates are intended to support internal understanding, planning, and readiness discussions.

  • You should consult qualified legal or compliance professionals before making regulatory or legal decisions.

Use of the Services does not create a lawyer–client, consultant–client, or fiduciary relationship.


3. User Responsibilities

By using the Services, you agree that:

  • Information submitted by you in forms or assessments is accurate and complete to the best of your knowledge.

  • Outputs from DesiPlat will not be represented as legal advice, formal compliance, or regulatory approval.

  • You will not copy, resell, sublicense, distribute, or publicly share DesiPlat content or materials without authorization.


4. Payments and Pricing

Certain Services are offered for a fee. Prices are displayed on the relevant pages or communicated prior to payment.

  • Payments are processed through third-party payment gateways.

  • DesiPlat does not store or process your payment card, banking, or wallet details.

  • Access to paid reports or document packages is provided only after successful payment confirmation.


5. Shipping and Delivery Policy (Digital Delivery)

All DesiPlat products and services are delivered digitally.

  • Assessment reports are generated and delivered via email and/or secure download links after successful payment.

  • Document packages are delivered via digital download links or email access.

  • No physical goods are shipped.

Delivery is typically completed within a few minutes of payment but may be delayed due to technical issues, third-party service outages, or incorrect contact information provided by the user.


6. Refund and Cancellation Policy

Due to the digital and automated nature of the Services:

  • No refunds or cancellations are permitted once a report or document package has been generated or delivered.

  • A service is deemed delivered once the digital report or access link is generated.

  • Refunds may be considered only in cases of duplicate payment or verified technical failure that prevents delivery, at DesiPlat’s discretion.

  • Any refund request must be submitted within 7 days of payment by contacting the support email listed below.


7. Intellectual Property

All content, assessments, reports, templates, text, branding, and materials provided through DesiPlat are the intellectual property of DesiPlat unless otherwise stated.

Users are granted a limited, non-exclusive, non-transferable license to use the materials for internal business or personal purposes only.

Unauthorized copying, redistribution, modification, or commercial exploitation is prohibited.


8. Limitation of Liability

To the maximum extent permitted by law:

  • DesiPlat shall not be liable for any indirect, incidental, consequential, special, or business losses arising from use of the Services.

  • DesiPlat’s total liability, if any, shall not exceed the amount paid by the user for the specific Service giving rise to the claim.


9. Service Availability and Changes

DesiPlat may modify, suspend, or discontinue any part of the Services at any time without prior notice.

These Terms may be updated periodically. Continued use of the Services after updates constitutes acceptance of the revised Terms.


10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India.

Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in India.
